Deepfake Porn Is Now a Crime. AI Girls Are Not.

On January 1, 2026, the Czech Republic switched on one of Europe's clearest deepfake porn laws: a new criminal offense, § 191a of the criminal code, called 'misuse of identity to produce and distribute pornography'. Making a fake nude of a real person without their consent is now a crime in itself. Sharing it online carries up to three years, organized or large-scale cases up to five. The rest of the EU is on the same road: a 2024 directive obliges every member state to criminalize non-consensual intimate deepfakes by 2027.
This matters to anyone who's ever typed 'undress AI' into a search bar, because most of what ranks for that phrase (upload-a-photo tools) just became a criminal instrument in one more country. Here's what the law actually says, where the line runs, and why the one configuration it doesn't touch is the one where nobody real is in the picture. (This is an informational overview, not legal advice.)
What the Czech deepfake porn law actually says
The new § 191a (introduced by amendment no. 270/2025 Sb.) criminalizes producing, offering, making publicly accessible, distributing or selling pornographic material (photo, film, computer-generated or otherwise) that 'depicts or otherwise exploits a person who did not consent to it'. That 'otherwise exploits' wording is aimed squarely at deepfakes: gluing a real person's face onto a generated body is covered even though the body isn't theirs. The base penalty is up to two years; spreading it over the internet, causing significant harm, or doing it for profit raises it to six months–three years; organized, cross-border or large-scale cases carry one to five years.
Two details people miss: production alone is enough. The fake nude sitting in your gallery, never posted, is already the offense once it was made without consent. And a second new provision (§ 181 para. 2) covers non-pornographic deepfakes made to seriously harm someone, so the 'it's satire, not porn' escape hatch is closed too.
What that means for 'undress AI' tools
Every tool whose workflow starts with 'upload a photo' now puts its Czech users one click from a criminal record. And Czechia is the direction of travel, not an outlier: the EU directive on combating violence against women (2024/1385) requires all member states to criminalize non-consensual intimate deepfakes by June 2027, and similar laws already exist from the UK to several US states. The tools themselves live offshore and vanish when payment processors drop them; the legal risk stays with the user who made the image.
It's worth saying plainly: this is the law working as it should. A fake nude of a classmate, a colleague or an ex is abuse of a real human being, and the fact that an AI drew the pixels changes nothing about the harm. Any platform that treats that as a feature is building on borrowed time. Which is exactly why we never did.
The configuration the law doesn't touch
§ 191a protects the identity of a person who didn't consent. An AI companion has no such person behind her: her face was never anyone's face, her body never anyone's body. There is no identity to misuse and no victim to harm. Explicit images of a woman who exists only as a character are outside what the offense is built to punish, in Czechia and everywhere else these laws are appearing, because the entire point of the law is the real human being.
DreamBabe enforces that boundary structurally, not with a policy page: there is no upload button anywhere on the platform. The undress and edit features only work on photos your own AI companion sent in your chat, her appearance is a locked character profile, and every companion is a fully invented adult. You couldn't commit § 191a with our editor if you tried. Which is precisely why the feature can be uncensored, on a regular card-payment platform, with nothing to hide.
The rules of thumb worth keeping
Never upload a photo of a real person to any undressing or face-swap NSFW tool. Not your crush, not your ex, not a celebrity, not 'just for yourself'. Production without consent is the crime; the internet upgrade to three years only comes after. If a tool asks for a photo of someone, the tool is the red flag.
If what you want is explicit AI imagery, use the lane the law leaves open on purpose: a companion who doesn't exist. Design her yourself, generate any scene in the Studio, tap Undress on her photos. Everything stays between you and a woman who was never real. Curious how that works in practice? Your first companion and her first photo are free.
Frequently asked questions
Is deepfake porn illegal?
Increasingly, yes. Czechia criminalized producing or sharing pornographic material of a real person without consent from January 2026 (§ 191a, up to 5 years in aggravated cases), and the EU requires all member states to criminalize non-consensual intimate deepfakes by June 2027. Similar laws exist from the UK to many US states.
Is it illegal to make a fake nude just for myself?
Under the Czech § 191a, production without the depicted person's consent is itself the offense. The image never has to be posted. Sharing it online is an aggravating factor, not the trigger.
Are AI-generated nudes of fictional people legal?
These laws protect real people's identities. A wholly invented AI companion has no victim and no identity to misuse. That's the configuration undress and NSFW features are built on here: no uploads, AI-only characters, every companion an invented adult.
Can I upload someone's photo to DreamBabe?
No, there is no upload anywhere on the platform, by design. Edits only work on photos your own AI companion sent in your chat, so the platform is structurally incapable of touching a real person's image.
